THE INTEGER BRANDED VISA DEBIT CARD


TERMS AND CONDITIONS FOR THE USE OF YOUR “INTEGER” BRANDED VISA DEBIT CARD

The Integer branded Visa Debit card (defined below as “the Card”) is issued to you by Bidvest Bank at the request of Integer. The Card which is made available to you on the basis of your Home Loan Application is subject to the following Terms and Conditions:

  1. DEFINITIONS

    • Account” means the transactional Card linked Account opened by Integer.
    • Agreement” means the contract between you, Bidvest Bank and Integer, set out in these Terms and Conditions.
    • ATM” means an automated teller machine or any card operated machine or device or to Visa®’s ATM Network which accepts the Card or any other similar international network in which we may participate.
    • Bidvest Bank” means Bidvest Bank (previously known as Rennies Bank) Limited (Registration No. 2000/006478/06).
    • Card” means any card or cards issued by Bidvest Bank as a debit card bearing the name Integer and/or the service mark of VISA (whether or not it also bears the name and/or mark of any other person or entities) and include any such card issued in replacement or renewal thereof.
    • Cardholder” means any person to whom a Card is issued by Bidvest Bank and authorised to transact on the Account.
    • Card Limits” means the various limits prescribed by us in relation to ATM cash withdrawals, POS transactions and Cash Back.
    • Card Transaction” means any payment made or any amount charged for any goods, services and/or other benefits, withdrawal or transfer effected through the use of the Card in conjunction with the PIN of the Card at such ATMs and Merchant outlets and on such conditions as we may prescribe.
    • Cash Back” means the amount dispensed/withdrawn from the Merchants’ point of sale terminals.
    • Common Monetary Area” means Swaziland, Namibia, Lesotho and South Africa.
    • Home Loan” means the home loan offering provided by Integer to you secured by a mortgage bond over your property.
    • Home Loan Application” means your application for a Home Loan.
    • Integer” means Integer (Pty) Ltd (Registration No. 201988/000944/07)
    • Merchant” means any person, firm or corporation having a subsisting agreement with Bidvest Bank and Visa relating to the use and/or acceptance of a Card in payment to such person whether for goods, services or charges incurred, and which entity displays the Visa Acceptance Mark.
    • Merchant transaction” means a transaction entered into between you and a merchant.
    • Our” means Integer’s.
    • PIN” means a personal identification number, numeric symbols assigned by us (whether or not applied by you)
    • POS” means a Merchants’ point of sale terminal.
    • Their” means Bidvest Bank’s.
    • Visa” means Visa International Services Association (and all of its subsidiaries and affiliates) or one of its successors or assigns.
    • Visa Rules” means those rules, regulations, by laws as published from time to time by Visa, as amended, modified or substituted from time to time.
    • We” and “us” means Integer.
    • You” means the Account Holder.
    • Your” means the Account Holder’s.


  2. ISSUE OF THE CARD

    1. These Terms and Conditions (“this agreement”) shall apply without exception on issue of the Card and any additional and replacement Cards;
    2. Upon receipt of the Card, you are requested immediately to sign the back of the Card in the space provided, with a ballpoint pen for security purposes;
    3. The Card is valid from the date of issue until the last day of the month reflected on the front of the Card, the date the Account is closed, or the date your right to use the Card is terminated in terms of clause 10;
    4. The Card belongs to Bidvest Bank and will remain its property at all times;
    5. If at your request we issue an additional Card on your Account for use by a person nominated by you, you will be responsible for any debit amounts arising through the use of the Card;
    6. The issue of additional Cards will not affect any Integer Credit facility granted on your Account;
    7. You will be charged our current fees and charges as are provided in our fees schedule on our website www.integer.co.za for the issue and use of such Cards.


  3. USE OF THE CARD

    1. You are the only person who may use your Card and you should not allow any other person to use it;
    2. The Card is issued to you with a unique PIN;
    3. When paying for goods at a merchant, you will be requested to sign the transaction slip if the transaction was successful;
    4. Should you enter the PIN incorrectly in 3 consecutive attempts on one day, further access will be denied until the day thereafter;
    5. Should the PIN be forgotten or compromised, a new Card and PIN will be issued at your request via the Integer Client Contact Centre (0861 4 66 33 4);
    6. You must comply with exchange control regulations when using the Card outside the Common Monetary Area.
    7. Should you request Account information from the Integer Client Contact Centre, you will be obliged to answer correctly a number of security questions to confirm your identity;
    8. You may not use the Card for transactions that will exceed the Integer daily transactional limits and the Integer Credit facility granted on your Account;
    9. Any Credit facility which Integer may grant will be governed by the Integer Credit facility Terms and Conditions;
    10. You will use the Card at your own risk. We will not be responsible for any loss, theft or fraud resulting from such use;
    11. The Card may not be used for any unlawful purpose, including the purchase of goods or services prohibited by local law applicable in the Republic of South Africa;
    12. You must comply with all relevant legislation at all times, including but not limited to legislation applicable to the combating of money laundering.


  4. AUTHORITY TO DEBIT YOUR ACCOUNT

    1. You hereby authorise us to debit your Account with:

      • All payments to merchants for purchases made by you using your Card or where we act on any instruction from you; debit order and 3rd party transfer instructions, regardless of whether the slip or vouchers are signed;
      • Our standard service fees (where applicable) and those penalties specified by us as per the attached fee schedule;
      • You will be notified of fee changes from time to time;
      • All applicable government levies in respect of the use of the Card;

    2. You will remain liable for any debit amount until your Account is in credit;
    3. Should you have a dispute with a supplier, we are unable to reverse or charge back any payment. Any such dispute must be resolved by you, with the supplier or merchant.


  5. ELECTRONIC PAYMENT INSTRUCTIONS

    1. Should you utilise any electronic payment system such as internet banking, POS and/or ATM networks:

      • You are obliged to provide the beneficiary’s correct account number and bank details;
      • We rely on the information provided by you and we are not obliged to check that the name of the beneficiary accords with the account number, and
      • You have no right to recall a payment instruction and we cannot recall, correct or cancel a payment, or demand repayment. The same applies to the beneficiary’s bank.


  6. AUTHORISED USE

    1. The safekeeping of your Card and PIN is your responsibility and you should keep any record of the PIN separate from the Card and in a safe place;
    2. If your Card is lost or stolen or your PIN has become known to another person, you must notify the Integer Client Contact Centre immediately. Delay in notifying Integer of the loss or theft of your Card will be deemed to be negligence on your part;
    3. Integer will stop the Card as soon as reasonably possible after being advised;
    4. You will be responsible for all amounts debited to your Account through use of the Card prior to you notifying us that the Card has been lost or stolen;
    5. You may dispute that any purchase or withdrawal debited to the Account was authorised by you. We will investigate the matter after we receive an affidavit from you to the effect that you did not authorise the transaction.


  7. STATEMENTS

    1. We shall provide monthly statements of the Account showing the transactions entered into by use of your Card, as well as other applicable fees and charges in respect of your Account;
    2. If you believe that your transaction history contains errors you must notify the Integer Client Contact Centre of the error in writing within 30 (thirty) days of receipt of the transaction history, failing which you will have no claim whatsoever in respect of or arising from such error(s).


  8. INTEREST

    1. We will pay you interest, at a rate which will be determined by us from time to time, in respect of any daily credit balances in your Account. Such interest will be credited to your Account on a monthly basis;
    2. You will pay interest at the rate determined in the Integer Credit Facility Agreement Terms and Conditions, in respect of any debit balances on your Account. Such interest will accrue on a daily basis from the day after the date of the debit balance upon and including the date on which full repayment is credited to our Account, and will be compounded monthly in arrears;
    3. In the absence of an allocation, all deposits to your transactional account will be credited firstly to service fees and interest and finally to the principal debt;
    4. International purchase and ATM withdrawals are converted to Rand at the prevailing wholesale exchange rate.


  9. OPTIONAL SERVICE AVAILABLE ON THE CARD

    1. You may avail of a messaging service, which enables you to track your transactions on your account.
    2. You will receive real-time confirmation by SMS or e-mail of deposits into your account, electronic transfers, withdrawals and purchases, which will be sent to your nominated cellphone or e-mail address.
    3. You are responsible for ensuring that we have your correct cellphone and e-mail address at all times.
    4. We will not be responsible if an SMS or e-mail is sent to the incorrect number or address if you have not updated your records with us.
    5. We cannot guarantee the accuracy or arrival time of an SMS or e-mail, as we are dependent on external service providers who are responsible for the delivery of the information.
    6. Whilst we will use our best endeavours to ensure the integrity and content of any SMS or e-mail, sent to you, your monthly statement will remain the definitive record of your account transactions.


  10. TERMINATION OF THE RIGHT TO USE THE CARD AND CLOSING OF THE ACCOUNT

    1. You may terminate your right to use the Card at any time on written notice to us. The Card must be destroyed by cutting through the magnetic stripe and the Card number so as to prevent further use. A Card that is not destroyed correctly may still be used and you will be held liable for the transactions;
    2. We may at our sole discretion close your Account and terminate your right to use the Card, at any time on 10 business days’ written notice to you. You should destroy your Card as set out in Clause 10.i above;
    3. You will remain liable for all transactions effected subsequent to the Account being closed;
    4. We shall be entitled to inform any Merchant, credit reference agency or other person entitled to such information of the closing of the Account after giving you 20 business days notice of our intention to do so.


  11. CONSENTS AND CONDUCT OF THE ACCOUNT

    1. You, the Accountholder agree that we:

      • May enquire about your credit record with any credit reference agency and any other party to confirm the details on the application;
      • May provide regular updates regarding the conduct of the Account to the credit reference agencies and the Credit Providers Association.


  12. LIABILITY

    1. Integer and Bidvest Bank shall not be liable to you:

      • for any loss or damage that you may suffer as a result of our provision of incorrect information to any person (including any credit reference agency) if such information was provided by Integer and/or Bidvest Bank in good faith;
      • as a result of any terminal failure or malfunction beyond Integer and/or Bidvest Bank’s reasonable control as a result of the failure or malfunction of any other device used to produce or process transactions with the Card;
      • if any Merchant does not accept the Card or Integer and/or Bidvest Bank refuse to authorise any transaction on the Card;
      • for any loss or damage of whatsoever nature and howsoever arising from all other causes.


  13. ADDRESSES AND NOTICES

    1. We shall send notices to the postal address or, where applicable for legal proceedings, to the street address specified on your home loan application form or otherwise elected by you.
    2. You must notify us in writing immediately if your chosen street address changes;
    3. You shall send any notices or other communication to: Integer Transactional Card Services, Suite 233, Private Bag X335, Cape Town 8000;
    4. We are entitled, but not obliged, to send you any notices to an e-mail address you specified on your application form. Such e-mail communication will be regarded as having been received by you, unless the contrary is proved.


  14. GENERAL

    1. You may not vary or amend any of these Terms and Conditions;
    2. On renewal or replacement of your Card, current Terms and Conditions will be provided. By using your Card you will be deemed to have accepted the rules in force at the time;
    3. If there is a difference between our records and your records, our records will be binding unless you satisfy us to the contrary;
    4. If a cheque or other negotiable instrument is deposited into and credited to your Account, it will be available as cash only after it has been honoured;
    5. We will be entitled to debit your Account with the amount of that cheque or negotiable instrument plus the resultant fee as per the fee schedule on our website www.integer.co.za, if it is dishonoured;
    6. These Terms and Conditions may be amended by Bidvest Bank or Integer from time to time. The amended Terms and Conditions will be displayed on the website www.integer.co.za, and will also be available from the Integer Client Contact Centre on 0861 4 66 33 4.
    7. If we take legal action against you to recover any amount due to us in terms of this Agreement, you will be liable for our costs (including all legal fees and collection commission) on the scale as between attorney and own client;
    8. You agree that we may take any legal action against you in the Magistrates Court, even if our claim against you exceeds the jurisdiction of the Magistrates Court;
    9. A certificate signed by any of our managers (whose appointment need not be proved) as to the amount of your debt to us, the fact that the amount is payable, the rate of interest payable and the date from which such interest is calculated, will be sufficient proof of the facts stated in the certificate unless the contrary is proved;
    10. You must immediately inform us if you are placed under administration, become insolvent or have any other form of legal disability;
    11. Every provision of this Agreement is deemed to be separate and severable, the one from the others. Should any provision be found to be unenforceable for any reason, the remaining provisions shall nevertheless continue to be of full force and effect;
    12. The Agreement will be governed by and construed in accordance with the laws of the Republic of South Africa;
    13. You hereby instruct and authorise us to hand your Card and PIN to our courier service company, for collection by you or delivery to you, and you hereby indemnify us against any claims, damages and losses arising from this authority and instruction.
